Terms of Service and Sale

1. Purpose

These Terms of Service and Sale (hereinafter "Terms") define the conditions of access to and use of the Strugggl service (hereinafter "the Service"), available at strugggl.com, as well as the conditions of sale of the subscriptions and credits offered on the Service.

2. Acceptance of the Terms

Registering for the Service implies full and complete acceptance of these Terms. The user acknowledges having read them and agrees to comply with them. Every purchase requires express acceptance of these Terms at the time of payment.

3. Description of the Service

Strugggl is a conversation service with virtual personalities generated by artificial intelligence. These personalities have standards of their own: their attention is earned over the course of the exchanges. The characters are entirely fictional. The Service does not constitute a dating service between real people.

Some content, including photos, may be suggestive; for this reason the Service is reserved for adults (Article 4).

4. Access conditions

Access to the site and browsing the personas are open to everyone. Conversations with the personas are reserved for adults (18 years and older): the user represents and warrants that they are at least 18 years old when talking with a persona or registering.

Strugggl may request age or identity verification at any time, in particular during a conversation when there are signs that the user may be a minor. Without such proof, access to conversations may be suspended.

5. Registration and account

The user agrees to provide accurate information when registering. They are responsible for the confidentiality of their credentials and for any activity carried out from their account. Any unauthorized use must be reported immediately.

6. Subscriptions and credits

6.1 Trial offer

Some subscriptions may include a trial period (its length and price are shown on the dedicated page before signup). Unless cancelled by the user before it ends, the trial automatically converts into a recurring paid subscription at the rate shown at signup.

6.2 Recurring subscription

Subscriptions are monthly, with no minimum term, and renew automatically every month until cancelled. Prices, billing frequency and, where applicable, the trial end date are shown in euros, all taxes included, on the dedicated page before any payment is confirmed.

6.3 Credits

Credits are sold in one-off packs or granted monthly with some subscriptions. They give access to additional content and features (photos, gifts…). Credits:

  • do not expire as long as the account is active;
  • are not refundable, exchangeable for money, or transferable to another account;
  • are lost if the account is deleted, at the user's request or following termination for breach of these Terms.

If Strugggl permanently stops providing the Service, purchased and unused credits are refunded.

6.4 Transparency and consent

Before confirming a payment, the user is clearly shown the amount due, the billing frequency and, where applicable, the date of the first recurring charge. Confirming payment constitutes acceptance of these Terms and of the purchased offer.

6.5 Payment methods

Payments are processed by our provider Stripe and can be made by credit card or any other method offered on the Site. Strugggl does not store users' bank details.

6.6 Price changes

Strugggl may change the price of its subscriptions. Any increase is notified by email at least 30 days before it applies. A user who does not accept it may cancel their subscription before that date at no cost; otherwise the new price applies from the next renewal. Credit pack prices are those displayed at the time of purchase.

6.7 Refunds

Unless a specific offer expressly provides otherwise, payments are non-refundable once the service has been rendered (see also Article 7 on the right of withdrawal). A refund is however granted in the event of a clear billing error or a failure of service attributable to Strugggl. Requests must be sent to [email protected] stating the transaction reference; a response is provided within 14 business days.

6.8 Cancelling a subscription

The user may cancel their subscription at any time from their personal space ("Manage my subscription") or by emailing [email protected]. Cancellation takes effect immediately: no further charge is made, but access remains active until the end of the already-paid period. If cancellation occurs before the end of a trial period, the first recurring charge is not billed.

7. Right of withdrawal

A consumer user in principle has 14 days from the conclusion of the contract to withdraw, without giving any reason.

At the time of payment, the user expressly requests immediate access to the Service by accepting these Terms. As a result:

  • Credits and digital content supplied immediately: in accordance with Article L221-28 13° of the French Consumer Code, the user expressly waives their right of withdrawal once the credits are made available.
  • Subscriptions: the user keeps their right of withdrawal for 14 days. In accordance with Article L221-25 of the French Consumer Code, if they exercise it after requesting immediate performance, they owe an amount proportionate to the service supplied until they communicated their decision to withdraw. The remainder is refunded within 14 days, using the payment method used for the purchase.

8. Legal guarantee of conformity

Strugggl is liable for any lack of conformity of the Service and of the digital content supplied, under Articles L224-25-12 et seq. of the French Consumer Code. For a service supplied continuously, the guarantee covers the whole supply period. In the event of a lack of conformity, the user may obtain that the Service be brought into conformity or, failing that, a price reduction or termination of the contract. Any claim may be sent to [email protected].

9. User conduct

The user shall not:

  • Use the Service for illegal purposes
  • Attempt to bypass security measures
  • Share their account with third parties
  • Publish or distribute content generated by the Service
  • Use the Service if a minor
  • Automatically extract or copy content from the Service (bots, crawlers, scraping), except search engines that follow robots.txt and tools provided by Strugggl
  • Decompile, disassemble or reverse engineer the Service, its software or its personas, except where the law expressly allows it
  • Seek to obtain the personas' instructions, settings or internal mechanisms, through conversation or by any other means
  • Send messages automatically or in bulk, or use the Service to train, evaluate or replicate another artificial intelligence system

Any breach of these rules may lead to the suspension or closure of the account (section 12).

10. Intellectual property

All content on the Service (text, images, logos, software) is the exclusive property of STRGL (company being incorporated). Content generated as part of interactions is the property of STRGL. The user has a personal, non-transferable right of use.

11. Liability

Strugggl undertakes to provide the Service with due care and is liable for failures to meet its obligations as provided by law. It cannot be held liable in the event of misuse of the Service by the user, the act of a third party, or force majeure. The Service may be temporarily interrupted for maintenance; Strugggl strives to keep such interruptions short. The virtual personalities do not provide medical, legal, or financial advice.

Nothing in these Terms limits the rights that a consumer user holds under the law.

12. Account deletion and termination

The user may request deletion of their account at any time by emailing [email protected]; deletion is carried out within 30 days. Strugggl reserves the right to suspend or delete an account in the event of a serious breach of these Terms, after notifying the user by email, except in an emergency or where required by law.

13. Complaints

Any complaint may be sent to [email protected]; a response is provided within 14 business days.

14. Applicable law and jurisdiction

These Terms are governed by French law. Failing an amicable settlement, any dispute falls under the jurisdiction of the competent French courts. A consumer user may choose to bring proceedings before the court of the place where they lived when the contract was concluded or where the harmful event occurred.

These Terms are written in French and may be translated. In the event of any discrepancy between language versions, the French version prevails.
